Search Wayne County Clerk Records

Wayne County Clerk records are county records, not trial-court case records. A Wayne County Clerk records search can include marriage licenses, recorded wills, deeds, mortgages, liens, releases, plats, notary filings, elections, and motor vehicle transactions. The County Clerk is separate from the Circuit Court Clerk, so criminal cases, divorce decrees, traffic files, and court dockets should be requested through the court clerk instead. County document access starts with the clerk's office, the official online records instructions, or a direct request.

Wayne County Clerk Record Types

Heather Piercy's office handles records that are different from Wayne County court files. The official records page lists categories and fees for deeds, mortgages, liens, wills, plats, releases, powers of attorney, corporate records, and related recorded documents. The marriage-license page covers license requirements, prohibited marriages, acceptable identification, the $60.00 license fee, and the address where the completed license must be returned after the ceremony.

Search Wayne County Clerk Records Online

The Wayne County Clerk online records page gives an unusually specific public access instruction. It says all documents are available online at no charge at waynecountyky.com and that the user needs a username and password. Both are public in lowercase. The official source did not expose the underlying search interface or field labels, so the verified instruction is the no-charge access path and the public credentials, not a field-by-field portal inventory.

Request Wayne County Clerk Copies

A county-record copy request should be sent to the County Clerk only when the record is within Heather Piercy's office. Marriage licenses, recorded wills, deeds, mortgages, liens, releases, plats, and affidavits of descent are County Clerk records. Divorce decrees, criminal dispositions, traffic records, court probate files, and civil case judgments are court records. Those go to Patricia Lay's Office of Circuit Court Clerk at the Justice Center.

  1. Identify the record type first. If it is a recorded document or marriage license, use the County Clerk. If it is a court case file, use the Circuit Court Clerk.
  2. Search the online records system with the public credentials when the record is a County Clerk document that may be online.
  3. Gather names, document type, date range, book and page if known, and the number of copies needed.
  4. Contact the County Clerk by phone, email, fax, mail, or in person to confirm copy cost, certification availability, and delivery method.
  5. Pay the current fee and provide a return address or pickup instruction if the office can issue the requested copy.

Wayne County Clerk Request Fields

The County Clerk site includes a contact form on its office page. The research captured the required fields. For formal record access, Kentucky open-records requests may be hand delivered, mailed, faxed, or emailed to the agency custodian under KRS 61.872, but the clerk's ordinary records channels should be used first for routine county document copies.

The contact form is useful for county-record questions, but court case files should still be directed to Patricia Lay's court office.

Wayne County Clerk Recording Fees

The official Wayne County Clerk recording fees page supplies specific minimum fees. These are recording fees, not court filing fees. They apply to County Clerk document recording such as deeds, mortgages, releases, liens, wills, and plats. Court filing or copy costs for Circuit, Family, or District Court are separate and should be confirmed with Patricia Lay's office.

The fee page is shown in the captured image from the Wayne County Clerk recording-fees page.

Wayne County Marriage Clerk Services

Marriage licenses are County Clerk records in Wayne County. Both parties must apply together. The official Wayne County Clerk marriage-license page states that both parties must be 18 or older unless minor rules apply, there is no waiting period, blood test, or physical requirement, and the license is valid for 30 days, including the date issued. The license is valid anywhere in Kentucky.

The published Wayne County marriage license fee is $60.00. Accepted payments are cash, certified check, cashier's check, money order, personal check, Visa, Discover, AMEX, or MasterCard. After the ceremony, the completed license is returned to Wayne County Clerk's Office, 55 N. Main St., Suite 106, Monticello, KY 42633. Divorce records are not County Clerk records; those are court records through the Circuit Court Clerk and state certificates through Kentucky OVS from June 1958 forward.

Wayne County Clerk Wills

The County Clerk records system includes recorded wills and related filings, but Kentucky probate case files are court files. District Court handles probate of wills, while Circuit Court handles contested probate matters. Use Heather Piercy's office for recorded wills, renunciations, disclaimers, affidavits of descent, and inheritance-tax liens. Use Patricia Lay's office for a District Court probate file, estate administration record, appointment, inventory, settlement, or contested Circuit Court probate matter.

That office split keeps probate searches accurate. A recorded will fee from the County Clerk schedule does not prove that an estate case was opened, closed, contested, or distributed by the court. It only shows the recorded document side.

Wayne County Clerk Boundaries

Wayne County has several official record offices. Heather Piercy is the County Clerk for county records. Patricia Lay is the Circuit Court Clerk for court records. Sheriff Tim Catron's office, available through the official sheriff programs page, handles sheriff services and does not keep County Clerk documents. Jailer Ronnie Ellis is listed on the official Wayne County Jailer page for detention center matters, not deed, will, or marriage records.
